Spotify Wins Lawsuit Over Eminem’s Music Licensing Dispute, No Damages Awarded

Spotify has won a lengthy court battle over allegations that it streamed Eminem's music without proper licensing. The case, initiated in 2019 by Eight Mile Style, Eminem's publisher, sought approximately £30 million, claiming Spotify did not correctly license songs like LOSE YOURSELF and WITHOUT ME, despite their massive streaming numbers.

The Tennessee court ruled in favor of Spotify, stating that although Spotify lacked licenses for the tracks, it would not be liable for damages. The court determined that if any copyright infringement penalties were due, they would be the responsibility of Kobalt Music Group, which managed royalties for Eight Mile Style. Spotify had argued that Kobalt misled them about controlling the rights to Eminem’s music and had accepted royalty payments without objections from Eight Mile.



The judge's opinion highlighted that Eight Mile Style had not properly communicated changes in licensing rights and had missed opportunities to address the issue earlier. This oversight, combined with Spotify’s agreement with Kobalt, which lacked a detailed song database, led to confusion over streaming rights. Consequently, Spotify is not liable for damages, but Kobalt will need to cover the legal costs incurred over the five-year case.
