Lawyer Akuoku-Nyantekyi Talks Protecting Intellectual Property for Actors and Commercial Models
Lawyer David William Akuoku-Nyantekyi

In the second part of the conversation with Lawyer David William Akuoku-Nyantekyi, we dove deep into the murky waters of intellectual property rights for actors and those who grace our screens as commercial models here in Ghana. Lawyer David William Akuoku Nyantakyi brought to light an issue that often gets swept under the rug - the rights of performers.

He explained that in the Ghanaian entertainment scene, actors usually work under what we call work-for-hire agreements. This means that once you perform, the production company pretty much owns every frame, every line, every expression - everything you bring to the character. But Nyantakyi was quick to point out there's wiggle room.

He suggested that actors can push for better terms, like success fees or residuals. These are essentially bonuses or ongoing payments if your work keeps making money or pulling in viewers. It's about ensuring that if your face or performance is still out there, racking up views or boosting sales, you see some of that success in your bank account too.

Nyantakyi shared anecdotes from his practice, where he's managed to negotiate these clauses into contracts, giving actors a slice of the pie even after the cameras stop rolling. He emphasized the critical need for actors to really read and understand what they're signing. Too often, he noted, performers sign away rights they barely understand in their eagerness to get on set or in front of the camera.

But here's the catch - while there are bodies like the National Film Authority that aim to safeguard these rights, the real power, Nyantakyi argued, lies with the creatives themselves. It's not just about hoping for protection; it's about actively seeking it. Whether that means doing your own homework on contract law or hiring someone who knows the ropes, being proactive is key.

This part of the discussion wasn't just about legal advice; it was a wake-up call. It's about actors and models in Ghana understanding that their image, their talent, is more than just a one-time gig. It's an asset that deserves protection, negotiation, and respect long after the applause has faded.
