Daddy Lumba Laid To Rest After Court Injunction Collapses

The burial and final funeral rites of Ghanaian highlife legend Daddy Lumba, born Charles Kwadwo Fosu, were successfully held yesterday, Saturday, December 13, 2025, after a court injunction that briefly threatened to halt the ceremony collapsed.

The legal challenge, initiated by some maternal family members of the late musician, became ineffective when the applicants failed to pay a GH¢2 million undertaking ordered by the court. The undertaking was a key condition attached to the injunction and was meant to cover potential costs and damages arising from the disruption of already planned funeral activities.

Earlier, the Accra High Court, presided over by Justice Emmanuel Kofi Diaba, had granted an interlocutory injunction restraining the family head, Kofi Owusu, from organizing the final funeral rites. The court also barred Transitions Funeral Home from releasing Daddy Lumba’s body pending the final determination of the substantive issue regarding who should lead the funeral arrangements.

In its ruling, the court acknowledged that postponing the burial could lead to increased costs but noted concerns raised in affidavits that the immediate family had allegedly been sidelined in the planning process. Justice Diaba stressed that the authority of the family head must be exercised in consultation with the immediate family and ordered that a stakeholder meeting be convened within three weeks to agree on a new burial date. The court further directed that all funds raised for the funeral be separated from the accounts of the Daddy Lumba Memorial Foundation.


Shortly after delivering the initial ruling, the court reconvened and issued a further order, stating that due to costs already incurred, the applicants were required to deposit a GH¢2 million undertaking by 2:00 p.m. Failure to meet this condition would result in the injunction being vacated and the funeral proceeding as planned.

By close of day, lawyers for the family head confirmed that the applicants were unable to pay the required amount. Consequently, the interlocutory injunction was vacated, and an order was issued directing Transitions Funeral Home to release the body, allowing the burial and final funeral rites to take place later that day.

The court’s decision was grounded in the 2024 Practice Direction on the determination of applications for injunctions to restrain the burial of a deceased person. Although Practice Directions do not carry the force of law, they serve as guiding protocols for the administration of justice in Ghana.

Despite the legal tussle that preceded the burial, Daddy Lumba was finally laid to rest yesterday, bringing closure to days of uncertainty surrounding the funeral of one of Ghana’s most celebrated music icons.
