Court Halts Adu-Boahene Trial Pending Supreme Court Ruling On Legal Vacation Injunction

The Accra High Court has suspended the criminal trial of former National Signals Bureau (NSB) Director-General Kwabena Adu-Boahene and his wife, Angela Adjei-Boateng, pending the Supreme Court’s determination of an injunction application challenging the conduct of trials during the legal vacation.

Justice Francis Apangabuno Achibonga, a Court of Appeal justice sitting as an additional High Court judge, adjourned the case to August 25, 2026, at 9:30 a.m. The judge noted that although an injunction application does not automatically stay proceedings, he would not continue the trial while a superior court is being asked to restrain it.

The injunction application, which seeks to stop specialised High Courts from hearing criminal matters during the legal vacation, is scheduled to be heard by the Supreme Court on August 20.

When the matter was called on Monday, defence counsel Peter Osei-Asamoah, holding brief for Samuel Atta Akyea, informed the court of a letter from Mr Atta Akyea requesting an adjournment to October, citing professional commitments during the vacation period. He also drew the court’s attention to the pending Supreme Court application.

Deputy Attorney-General Dr Justice Srem-Sai opposed the request for a longer adjournment. The court rejected the bid to push the case to October but declined to proceed further until the Supreme Court rules.

Adu-Boahene and his wife are standing trial over the alleged diversion of GH¢49.1 million intended for the procurement of a cyber-defence system. 

They have pleaded not guilty to charges including wilfully causing financial loss to the state, using public office for personal gain, money laundering, and related offences.

The case forms part of ongoing proceedings that have seen several procedural applications in recent months.
