In a landmark decision, Ghana’s Supreme Court has ruled against Speaker of Parliament Alban Bagbin’s move to declare four parliamentary seats vacant. The ruling came in response to a legal challenge brought by Majority Leader Alexander Afenyo-Markin.

The seven-member panel, led by Chief Justice Gertrude Torkornoo, delivered a 5-2 majority decision siding with Afenyo-Markin. Chief Justice Torkornoo stated that a detailed explanation of the ruling will be provided later.

The dispute centers on Speaker Bagbin’s interpretation of Article 97(1)(g) of the Ghanaian Constitution, which he cited to justify his decision to vacate the seats. Bagbin’s action was met with strong legal and political opposition, with Afenyo-Markin arguing that the Speaker had overstepped his authority by circumventing judicial review and preventing the possibility of by-elections in the affected constituencies.

This ruling underscores the judicial system’s role in interpreting the limits of parliamentary authority under the Constitution and has significant implications for the balance of power within Ghana’s political landscape.
