Court Of Appeal Strikes Out AG's Stay In Sedina Tamakloe Case

The Court of Appeal on Wednesday struck out the Attorney-General’s application seeking to stay the execution of its judgment that acquitted and discharged former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer Sedina Christine Tamakloe-Attionu.

The three-member panel, presided over by Justice Sophia Rosetta Bernasko-Essah, took the decision after the State withdrew the application during proceedings.

Principal State Attorney Hilda Craig informed the court that the Republic had filed a notice of withdrawal on August 10. Defence counsel did not oppose the move.

Justice Bernasko-Essah noted that although the panel had been issued a warrant by the Chief Justice to sit and rule on the application, the withdrawal left no matter pending before the court. The application was therefore struck out as withdrawn.

The Attorney-General had filed the stay application on July 30, shortly after the Court of Appeal unanimously quashed Tamakloe-Attionu’s conviction and 10-year prison sentence. The State argued that the appellate ruling contained errors and sought to suspend its effect pending an intended appeal to the Supreme Court.

Tamakloe-Attionu, who served as MASLOC CEO between 2013 and 2017, was convicted in absentia by the Accra High Court in April 2024 on 78 counts, including stealing, causing financial loss to the state, money laundering and procurement offences. She had travelled to the United States for medical treatment during her trial and did not return.

She was extradited to Ghana in June 2026 and began serving her sentence at Nsawam Medium Security Female Prison.

On July 30, a different Court of Appeal panel set aside all the convictions, holding that the prosecution had failed to prove the charges beyond reasonable doubt and that the trial court had improperly shifted the burden of proof onto the accused.

With the stay application withdrawn and struck out, the July 30 acquittal and discharge now take full effect. Reports indicate a release warrant has been processed. The Attorney-General’s office has indicated it will pursue the matter at the Supreme Court.
